Yemen: Arrest and detention of Al-Abbab brothers

Three Al-Abbaba brothers were arrested on 19 July 2007 by agents of the political police (Amn Al-Assiyassi) and were held for the first two months in solitary confinement at their premises. They have been imprisoned without trial.

On 7 April 2009 Al-Karama sent a communication to the Working Group on Arbitrary Detention, asking it to intervene with the Yemeni authorities in cases of: 

- Mr. Amir Abdallah Thabet Mohsen Al-Abbab, 31, employee 
- Mr. Mouad Abdallah Thabet  Mohsen Al-Abbab, 24, student
- Mr. Mohamed Abdallah Thabet Mohsen Al-Abbab, 25, student 


All three were arrested at their home on 19 July 2007 at 2am by the political police (Amn Assiyassi) without a warrant and without mention of reasons for this inquiry. 

In fact, they wanted to stop the elder brother, Adel Al-Abbab Mohsen Thabet, professor of Arabic, wanted by the security services for alleged membership to Al-Qaeda. Having not found him, they took the three brothers and father, who was later released after two days of interrogation. 

The three brothers were transferred to the political police's prison in Sana'a where they spent two months in solitary confinement. Since then, they are in contact with their family, and their father visits them once a week. 

So far, and they have been detained for 19 months, no charges were brought against them and they have still not been presented before a magistrate or tried in court. Despite their repeated requests, they were unable to get a lawyer for their defense. 

The detention of the three brothers took place outside the legal framework, in violation of Yemeni law and the principles of international treaties such as the International Covenant on Civil and Political Rights and the Convention Against Torture, both ratified by Yemen on 9 February 1987 and 5 October 1991. 

Al-Karama demands that the Yemeni authorities obey the law by giving justice to the three men and letting them free. 

Al-Karama recalled that the Committee Against Torture considered the second periodic report submitted by the State in November 2009.
