Israel: Arbitrary arrest and detention of human rights defender Fuad Al Khuffash

Mr Fuad Al Khuffash (فؤاد الخفش), aged 36 years and living in Nablus, West Bank, is a human rights defender. He is a well known human rights defender in Palestine that especially focuses on the rights of Palestinians prisoners in Israel. Mr Al Khuffash is the director of the "Ahrar For Prisoners Studies and Human Rights".

On 28 June 2011 at three o'clock in the morning, Mr Al Khuffash was arrested at his home by members of the Israeli Defence Forces (IDF) before being taken to Al Hawara detention Centre near Nablus, where he remains detained without any official charge to date.

On 1 July 2011, Alkarama submitted Mr Al Khuffash's case to the UN special procedures and more particularly to Special Rapporteur on the situation of human rights defenders with a copy to the Special Rapporteur on the promotion and the protection of the right to freedom of opinion and expression and the Working Group on Arbitrary Detention.

Mr Al Khuffash was previously arrested and tortured many times in Israeli prisons because of his human rights' activities; the last arrest was on 26 January 2006 after which he was held to administrative detention for six months, before being released without trial.

During the raid of Mr Al Khuffash's home, the military forces destroyed the door and searched the entire house. The forces did not present any arrest or search warrant during the arrest, nor did they give his family any reason for his detention.

It is clear that Mr Al Khuffash's arrest is due to his human rights activities as well as for providing information to the UN Special procedures regarding the situation of Palestinians Prisoners in Israel. This is a violation of international human rights norms, and particularly resolution 12/2 of the Human Rights Council, which "calls upon States to ensure adequate protection from intimidation or reprisals for individuals and members of groups who seek to cooperate or have cooperated with the United Nations, its representatives and mechanisms in the field of human rights, and reaffirms the duty of all States to end impunity for such actions by bringing the perpetrators, including accomplices, to justice in accordance with international standards and by providing an effective remedy for their victims", (A/HRC/RES/12/2).

Many other human rights defenders, political activists and campaigners have also been persecuted by the Israeli authorities for having denounced the human rights violation by Israel.

Israeli authorities should immediately release Mr Fuad Al Khuffash and to refrain from arrests and persecution of human rights defenders and political activists.
