Algeria : The Human Rights Committee ask for a reply to their final observations

The Special Rapporteur for the follow-up of final observations to the Human Rights Committee sent a letter on 27 August 2009 to the permanent representative of Algeria to the United Nations reminding him that in the framework of the Committee‘s final observations, the State of Algeria has not submitted any information for three of of the observations during the stipulated period of one year. On 7 November 2007, the Algerian permanent representative made generalized comments concerning the Committee's final observations.

Alkarama submitted a report in the context of the follow-up to the recommendations made by the Human Rights Committee.

The Algerian government was asked to take concrete steps with regards to the following three recommendations:

Recommendation 11 :
The monitoring of all places of detention by the civilian prison administration and the prosecution and the establishment of a national register of detainees. The State party should take all necessary measures, in its legislation and in practice, to ensure that all custodial establishments are visited regularly by the International Committee of the Red Cross and also by an independent national organization.

Recommendation 12 :
Undertake, in all circumstances, to clarify and resolve each case of disappearance, in particular the circumstances of the case and the identity of the victims. The State party should furthermore ensure that any person held in secret detention is placed under the protection of the law, and that the right of these persons to be brought before a judge in the shortest possible time is duly respected. In the case of deceased persons, the State party should take all necessary measures to clarify the place and cause of death, together with the place of burial, and undertake to return the bodies of deceased persons to their families.

Recommandation 13 :
Ensure that every allegation of torture and cruel, inhuman or degrading treatment be inspected and that the training of state agents be improved in order to insure that every arrested or imprisoned person be informed of his/her rights.
